The Court of Appeal is today handing down its decision in the case of Clayton v Clayton. This may well have widespread repercussions for parents and children, in relation to the identification of children as having been the subject of court proceedings once those proceedings are over. Essentially, the decision concerns the balance between children’s right to privacy and their parents’ right to freedom of expression under the European Convention on Human Rights.
The Court of Appeal has decided that the prohibition from identifying children which section 97 of the Children Act 1989 provides only applies whilst the proceedings relating to the child in question are in progress. Once the proceedings have concluded, the protection given by the Act comes to an end, the entitlement to anonymity.

Being authorised by rules of court, such publication will not constitute contempt. Subsection (2) amends section 12 of the Administration of the Justice Act 1960 to make it clear that the reference in subsection (4) to publication which does not constitute contempt includes cases where the publication is expressly authorised by rules of court.

More than 200 MPs have called for the abolition of all secrecy in family courts.
There should be no gagging orders on parents who should be free like rape victims to waive anonymity and go to the press with their history, their identities, and their complaints (including details of the court proceedings, the witnesses who testified, and the judgement) if they believe their children have been unjustly taken.
These children are routinely advertised for adoption like pedigree dogs by social services in magazines Adoption UK. on the internet UK Kids Info. and even in the Daily Mirror!. All with full colour photos, first names and birth dates, allowing easy identification by the neighbours! The secrecy exists to gag protesting parents not to protect the identity of the children and should be scrapped! Also abolition of "jail with no public hearing" (a parliamentary question revealed that more than 200 persons were sent to prison in secret last year by family courts!).

No child can be identified by any posts on this website. Every child should be able to move on in future without reminder of past intervention by any authority. Many victims of the U.K. System are the children.
